Chapter 7
You may assume the new bankruptcy laws will prohibit you from filing a Chapter 7 debt elimination. This myth about bankruptcy is just not true.

You can still eliminate or wipe out credit card debt, medical bills, judgments, stop garnishments and keep your personal property. Obviously, there is a little more to this but the basics of bankruptcy have remained the same. As long as your income is within the guidelines set by the government, and your assets do not exceed the federal exemptions allowed, you may qualify for relief by filing a Chapter 7 bankruptcy case.

Some exceptions include taxes owed to the IRS or state, student loans, alimony, maintenance/child support payments, secured debts unless you surrender the collateral, OWI related debts, and fraud-related debts. We can help you to understand which debts you may or may not be able to eliminate. Typically, Chapter 7 will eliminate the following:

  • Credit card debt
  • Personal or payday loans
  • Medical bills
  • Judgments
  • Deficiencies
  • Delinquent utility bills

Chapter 13 - Start Fresh Reorganization

If you earn too much income, are behind in you mortgage payments or car payments, and wish to save your home from foreclosure or your car from repossession, then filing a Chapter 13 may be your best answer to retake control of your life and finances. If you have a regular source of income, you can qualify for Chapter 13 bankruptcy. Many of our clients are gainfully employed but struggling to meet their monthly debts.

When you file for Chapter 13 bankruptcy, we will help you to set up an affordable three- to five-year plan for repaying your debts. Depending on which of your debts we are trying to help you save and which debts are unsecured, you may only be repaying a fraction of what you owe, and almost all debts are paid without any additional interest.

The Wisconsin Bankruptcy Alternative: Chapter 128

If you are facing temporary financial difficulties in Wisconsin, take a deep breath and don't panic. Our state has a unique debt relief option available for people in your exact situation.

What is Chapter 128 Debt Relief?

Chapter 128 is a law that allows Wisconsin residents to pay back their unsecured debts, such as credit card debt, outstanding medical bills, delinquent utility bills and personal or payday loans, in full over a three-year period with no interest. You do NOT have to appear in court and your payments are based on the amount you owe, not on a percentage of what you make.

Who Qualifies for Chapter 128?

Any resident of the state of Wisconsin can qualify for the substantial advantages offered by Wisconsin's Chapter 128 law. Chapter 128 is less expensive than Chapter 13, can be processed the same day of your appointment, and the qualification requirements are less stringent.
